1. Who can use Clutch Assist
Clutch Assist is a marketplace where verified college athletes ("Athletes") book home cleaning and mobile car detailing from independent local service providers ("Providers"). To use the Platform you must:
- be at least 18 years old and able to enter a binding contract;
- as an Athlete, be a current college athlete and pass our verification review;
- as a Provider, be legally allowed to work in the United States and pass our application review;
- give accurate information and keep it up to date, and keep your password private;
- use only one account, and not let anyone else use it.
We may refuse, suspend or close any account at our discretion, including if we believe information you gave us is false or your conduct puts other users at risk.
2. We are a marketplace, not the service provider
Clutch Assist connects Athletes with Providers and handles booking, payment, messaging and status updates. We do not perform cleaning or detailing services ourselves, and we do not employ Providers. Providers are independent businesses who decide which jobs to accept and how to do their work.
The service contract for each booking is between the Athlete and the Provider. We are not a party to it, we do not guarantee the quality, timing or outcome of any service, and we are not responsible for the acts or omissions of any Athlete or Provider. We do try to help when something goes wrong; see Section 9.
3. Verification and vetting
Athletes are asked for proof of athletic status (a .edu school email or an official roster link), a government ID photo and a selfie. Providers are asked for identity documents, the services they offer and their business details. Our team reviews these manually and may ask for more information, approve, or decline an application.
Our review is a reasonable-care check, not a guarantee. We may, but are not required to, run additional background or identity checks on Providers. We do not warrant that any user is who they say they are, and you should use your own judgment when letting someone into your home or handing over a vehicle.
4. Booking, prices and payment
Prices
Prices are set by Clutch Assist and shown before you confirm a booking. The total is the service subtotal, plus a Platform & Trust Fee of 3% of the subtotal, plus any tip you add. Tips go to the Provider in full.
How you are charged
Payments are processed by Stripe. When you confirm a booking we place an authorization hold on your card for the total; the charge is captured after the service is completed. For bookings more than five days ahead we save your card and place the hold about five days before the service. By booking you authorize these charges, any cancellation fee under Section 6, and any accepted condition surcharge under Section 5. If a charge fails we may cancel the booking.
Condition surcharges and tips
Some bookings involve a surcharge (Section 5) or a tip you choose at checkout. The final charge may differ from the original estimate only in those cases and only as shown to you in the app.
Recurring bookings
If you set up a recurring series, each visit is booked and charged as a separate booking under these Terms. Your saved card is authorized before each visit. If a payment cannot be authorized the series may be paused and you will be notified.
Promotions and credits
Promo codes and account credits are discretionary, may be limited in amount, number of uses or time, cannot be exchanged for cash, and may be withdrawn or corrected if we believe they were obtained or used in a way we did not intend.
5. Condition surcharges
If a Provider arrives and finds the job is materially harder than described (for example heavy buildup, a vehicle in much worse condition than stated), they may request a condition surcharge in the app with a photo. You have 10 minutes to accept or dispute it. The price changes only if you accept. If you do not respond, the request expires and the original price stands. A Provider may decline to continue a job that is materially different from what was booked.
6. Cancellations, fees and no-shows
These rules apply when an Athlete cancels. Where a fee applies, it replaces the 3% Platform & Trust Fee and any tip; nothing else is charged.
Home cleaning (scheduled)
- Free if you cancel more than 24 hours before the scheduled start, or within 60 minutes of booking, as long as the Provider is not yet on the way.
- $50.00 if you cancel within 24 hours of the start, or after the Provider is on the way.
Mobile car detailing (scheduled)
- Free if you cancel more than 12 hours before the scheduled start, or within 60 minutes of booking, as long as the Provider is not yet on the way.
- $35.00 if you cancel within 12 hours of the start, or after the Provider is on the way.
On-call detailing
- Free before a Provider has been dispatched.
- $15.00 dispatch fee once a Provider has been dispatched (free within 3 minutes of a Provider accepting).
Once service is under way
If you cancel after the service has started, or for on-call detailing after the Provider has arrived, the full booking price is charged and the Provider is paid.
If you are not there
If the Provider arrives at the scheduled time, waits a reasonable period and cannot reach you, the booking is treated as a no-show and the full price is charged.
If the Provider cancels or does not show
You are not charged. We will try to find another Provider; if we cannot, the booking is cancelled and your authorization hold is released or your payment refunded in full. Our responsibility in that case is limited to the refund.
The app shows the exact outcome before you confirm a cancellation.
7. Additional terms for Providers
Independent contractor
You provide services as an independent business, not as an employee, agent or partner of Clutch Assist. You choose which jobs to accept, supply your own tools, products, transport and insurance, hold any licenses the law requires, and are responsible for your own taxes. Nothing in these Terms creates an employment relationship, and you are not entitled to benefits from Clutch Assist.
Payouts
Payouts are made through Stripe Connect, and you must complete Stripe's onboarding before you can accept jobs. For each completed booking you receive 90% of the service subtotal plus 100% of any tip; Clutch Assist keeps 10% of the subtotal as its commission and the 3% Platform & Trust Fee. Payouts are sent after the Athlete's payment is captured and may be delayed by Stripe's own timing or by a dispute. Stripe may issue tax forms directly to you.
Doing the job
- Only you may perform a job you accepted; you may not send someone else.
- Keep the app updated as you travel, arrive, start and finish; those timestamps decide cancellation fees, no-shows and payouts.
- Treat the Athlete's home, belongings and vehicle with care; you are responsible for damage you cause.
- Do not request or accept payment or tips outside the Platform (Section 8).
- Cancelling accepted jobs, arriving late or failing to show is reviewed by our team and can lead to suspension or removal. A job you cancel is offered to other Providers and you can't accept it again.
We make no promise about how many jobs you will be offered or accept.
8. Keeping it on the Platform; monitoring
All bookings, payments and tips must go through the Platform. You may not use information from the Platform to arrange, pay for or solicit services outside it, and you may not ask another user to do so.
In-app messages are scanned automatically for signs of off-platform dealing (such as phone numbers, payment handles or "pay me in cash") and may be reviewed by our staff. Flagged messages may be hidden or redacted. Repeated violations lead to warnings, temporary suspension (currently 7 to 30 days, lifted automatically when it ends) and permanent removal.
9. Homes, vehicles, access and damage
- Athletes are responsible for giving accurate entry instructions, securing valuables, medicines and pets, and ensuring the home or vehicle is safe to work in.
- Providers are responsible for any loss or damage they cause while performing a service. Claims are between the Athlete and the Provider; Clutch Assist does not insure either party.
- If something goes wrong, tell us through Help in the app within 24 hours of the job ending. We will help the parties communicate and may, at our discretion, issue refunds or credits, but we are not obliged to.
- Providers may use their device location to confirm arrival at the service address; that location is used to confirm arrival only.
10. Reviews, photos and other content
You may submit reviews, photos (including condition-surcharge photos), messages and other content. You own your content and give us a non-exclusive, royalty-free, worldwide license to store, display and use it to operate and improve the Platform. Reviews must be honest and about your own experience. We may remove content that breaks these Terms. Athletes are never publicly rated.
11. Things you may not do
- give false information, impersonate anyone or create more than one account;
- harass, threaten or discriminate against another user;
- arrange or pay for services outside the Platform (Section 8);
- copy, scrape, reverse-engineer or interfere with the Platform or its security;
- use the Platform for anything unlawful or for any service other than those we offer.
12. Disclaimers and limitation of liability
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, CLUTCH ASSIST DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND MAKES NO WARRANTY ABOUT THE SERVICES PROVIDED BY PROVIDERS, THE CONDUCT OF ANY USER, OR THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE.
TO THE FULLEST EXTENT PERMITTED BY LAW, CLUTCH ASSIST AND ITS OWNERS, EMPLOYEES AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF DATA OR LOST PROFITS, ARISING FROM THE PLATFORM OR ANY SERVICE BOOKED THROUGH IT. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF $100 OR THE FEES YOU PAID TO CLUTCH ASSIST IN THE 12 MONTHS BEFORE THE CLAIM. Some states do not allow some of these limits; in that case they apply to the extent the law allows.
Release and indemnity
You release Clutch Assist from claims arising out of disputes between you and another user. You agree to defend and indemnify Clutch Assist against claims, losses and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your content, or your use of the Platform or performance of a service.
13. Dispute resolution: arbitration and class-action waiver
Please read this section carefully. It limits how you can bring claims against us.
Talk to us first
Before starting any formal proceeding, email leron@getclutchassist.com with your name, account email and a description of the problem. We will try to resolve it with you within 30 days.
Binding arbitration
If we cannot resolve it, any dispute between you and Clutch Assist arising out of these Terms or the Platform will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this agreement. The arbitrator may award the same relief a court could, to you individually. Either party may instead bring an individual claim in small-claims court if it qualifies.
No class actions or jury trials
YOU AND CLUTCH ASSIST EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO BRING OR JOIN A CLASS, COLLECTIVE OR REPRESENTATIVE ACTION. Claims may be brought only on an individual basis.
Opting out
You may opt out of this arbitration agreement by emailing leron@getclutchassist.com within 30 days of first accepting these Terms, with your name and account email and a clear statement that you opt out. Opting out does not affect the rest of these Terms.
Governing law
These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-laws rules. Any claim not subject to arbitration must be brought in the state or federal courts located in Maryland, and you consent to their jurisdiction.
14. Ending your account
You may stop using the Platform at any time and may ask us to close your account by emailing leron@getclutchassist.com. We may suspend or close your account if you break these Terms or if we stop offering the Platform. Bookings in progress, payments owed, Sections 8 through 13 and any other terms that by their nature should survive will survive closure.
15. Changes to these Terms
We may update these Terms. If a change is material we will notify you by email or in the app before it takes effect. Continuing to use the Platform after the effective date means you accept the updated Terms. The date at the top shows the current version.
16. General
These Terms and the Privacy Policy are the whole agreement between you and Clutch Assist about the Platform. If any part is found unenforceable, the rest still applies. Our failure to enforce a term is not a waiver. You may not transfer your account or these Terms; we may assign them to a successor. Notices to you may be sent to your account email.
17. SMS Terms (text messages)
Text messages are optional. If you opt in (by ticking "Text me booking alerts at this number" under your phone number, or turning on Text messages in Settings → Notifications), you agree that Clutch Assist LLC("Clutch Assist") may send recurring automated booking alerts to that number; you'll get one confirmation text when you opt in. Message frequency varies. Message and data rates may apply. Consent is not a condition of using the Platform. Reply STOP to cancel, HELP for help, or email leron@getclutchassist.com. Carriers are not liable for delayed or undelivered messages. Keep your phone number current in Settings → Account; how we handle your number is in Section 10 of our Privacy Policy, and program details are at getclutchassist.com/sms.
